By stepping into these public access areas, you signify your acceptance of and commitment to abide by these comprehensive terms, which are designed to ensure a safe, enjoyable, and lawful experience for all.
1. INTRODUCTION
Bastille Festival Adelaide (referred to as the Festival, we, us, or our) is a meticulously curated live event proudly owned and operated by BBR Group Australia Pty Ltd (ABN 93 121 083 805), a company dedicated to delivering exceptional experiences. The free entry sections of the Festival are thoughtfully designed to welcome the general public at no charge, offering an inclusive opportunity to engage with the festivities at Festival Plaza. These Terms & Conditions of Entry (Terms) serve as the governing framework for your presence and conduct within these designated free entry zones.
In addition to these Terms, you are also bound by the Venue Terms and Conditions established by Festival Plaza, the esteemed host venue. Should any conflict arise between these Terms and the Venue Terms and Conditions, the latter shall take precedence, reflecting our commitment to harmonising with the venue’s operational and legal standards.
2. ENTRY TO FREE SECTIONS
2.1 General Access
Entry to the free sections of the Bastille Festival is graciously provided at no cost, extending an open invitation to all members of the public eager to partake in this celebration of culture and community. However, this access is not unconditional, it is subject to capacity constraints, safety imperatives, and strict adherence to these Terms.
2.2 Right of Refusal
The Festival reserves the unequivocal right, exercised at its sole discretion, to refuse entry to or remove any individual from the free entry areas. This authority may be invoked in various circumstances, including but not limited to:
● Non-compliance with these Terms or any specific directive issued hereunder.
● Safety concerns that may jeopardise attendees, staff, or property, as assessed by Festival personnel.
● Instructions or mandates from Festival Plaza management or South Australian government authorities.
2.3 Capacity Limits
Entry is contingent upon availability within the designated free entry zones. Should these areas reach maximum capacity, as determined by Festival staff in consultation with Festival Plaza regulations, further access may be restricted to ensure compliance with safety standards and public comfort. Signage and staff announcements will provide real-time updates in such instances.
2.4 Accessibility Considerations
The Festival is committed to fostering an inclusive environment. Persons with accessibility needs are encouraged to contact us in advance via the Festival website to ensure appropriate accommodations, subject to venue capabilities and these Terms.
3. COMPLIANCE WITH SOUTH AUSTRALIAN LAWS
3.1 Legal Obligations
By entering the free sections, you pledge to uphold all applicable laws of South Australia, ensuring that your conduct aligns with the legal framework governing public events in this jurisdiction. Key statutes include, but are not limited to:
● Liquor Licensing Act 1997 (SA): Alcohol consumption is strictly confined to designated licensed areas managed by authorised vendors. The Festival adheres to Responsible Service of Alcohol (RSA) principles, prohibiting BYO alcohol unless explicitly authorised in writing by Festival management. Breaches may result in immediate removal and potential legal consequences.
● Public Health Act 2011 (SA): You are required to comply with any health directives issued by the South Australian Government at the time of the Festival. These may encompass measures such as mandatory mask-wearing, social distancing, proof of vaccination, or other protocols related to communicable diseases (e.g., COVID-19). Non-compliance may lead to exclusion from the Festival precinct.
● Summary Offences Act 1953 (SA): Any behaviour deemed disorderly, offensive, threatening, or otherwise disruptive is strictly prohibited. Such actions may prompt your removal from the Festival and referral to South Australia Police for further action, including fines or charges as applicable.
● Australian Consumer Law (ACL) as applied in South Australia: Your rights as a consumer regarding goods or services purchased from exhibitors within the free entry sections are protected under the ACL. However, all related disputes or claims must be addressed directly with the exhibitor, not the Festival (see Section 8 below).
3.2 Festival Enforcement
The Festival retains the right and responsibility to enforce these legal obligations rigorously. This includes cooperating fully with South Australian authorities such as police, health officials, or liquor licensing inspectors to maintain a lawful and orderly environment. Attendees found violating these laws will face immediate consequences, up to and including ejection and reporting to relevant agencies.
3.3 Updates to Legal Requirements
Given the dynamic nature of legislative and public health landscapes, the Festival may update its compliance requirements in response to new directives. Such updates will be communicated via signage, staff announcements, or the Festival website, and your continued presence constitutes acceptance of these changes.
4. VENUE TERMS AND CONDITIONS – FESTIVAL PLAZA
4.1 Legal Binding
The Festival is irrevocably bound by the Terms & Conditions established by Festival Plaza, our esteemed host venue. These venue-specific terms encompass a broad spectrum of operational rules, including but not limited to restrictions on prohibited items, safety protocols, maximum capacity thresholds, and behavioural expectations. As an attendee, you are equally obligated to adhere to these terms while within the Festival precinct.
4.2 Precedence
In the event of any inconsistency between these Terms and Festival Plaza’s Venue Terms and Conditions, the latter shall prevail. This hierarchy ensures seamless integration with the venue’s overarching governance structure, reflecting our contractual and legal commitments to Festival Plaza.
4.3 Access to Venue Terms
For your convenience and transparency, copies of Festival Plaza’s Terms & Conditions are readily accessible on their official website (www.festivalplaza.com.au) or may be obtained in person upon request at the venue’s administration office during the Festival. We encourage you to familiarise yourself with these terms prior to attendance.
4.4 Enforcement by Venue
Festival Plaza retains its own authority to enforce its terms, which may include refusing entry, conducting security checks, or ejecting individuals at its discretion. The Festival fully supports and complies with such measures, ensuring a unified approach to safety and order.
5. CONDUCT AND SAFETY
5.1 Behavioural Expectations
To cultivate a safe, welcoming, and enjoyable atmosphere for all attendees, you are required to:
● Promptly and courteously follow all directions issued by Festival staff, security personnel, or Festival Plaza representatives, whether verbal or via signage.
● Refrain from any behaviour that is offensive, disruptive, threatening, or likely to diminish the experience of others, including excessive noise, aggressive actions, or harassment.
● Abstain from introducing prohibited items into the Festival precinct (detailed in Section 9 below).
● Remain within the clearly demarcated free entry areas unless you possess a valid ticket for access to ticketed zones.
5.2 Consequences of Misconduct
Individuals found engaging in offensive, disruptive, or dangerous conduct, including violations of Responsible Service of Alcohol legislation or possession of illicit substances, will be subject to immediate removal from the Festival without the right to re-enter. The Festival reserves the authority to report such incidents to South Australia Police, potentially leading to legal repercussions such as fines or criminal charges.
5.3 Safety Reporting
Your safety is our priority. If you feel unsafe, distressed, or harassed at any point, we strongly encourage you to seek immediate assistance from Festival staff or security personnel, identifiable by their uniforms or badges. Emergency contact points will be clearly marked throughout the event-designated areas, and staff are trained to respond promptly and effectively.
5.4 Emergency Procedures
In the unlikely event of an emergency (e.g., fire, medical incident, or severe weather), you must comply with evacuation or safety directives issued by Festival or Festival Plaza personnel. Failure to do so may compromise your safety and that of others, and the Festival bears no liability for resultant harm.
6. CHILDREN AND SUPERVISION
6.1 Age Requirement
Children under the age of 16 are warmly welcomed within the free entry sections but must be accompanied by a responsible adult at all times. This adult, whether a parent, guardian, or authorised caregiver, assumes full responsibility for the child’s behaviour, safety, and wellbeing throughout their attendance.
6.2 Supervision Responsibility
The Festival does not provide childcare or supervision services. Any injury, loss, or damage suffered by a child due to inadequate supervision rests solely with the accompanying adult. This includes incidents arising from wandering into restricted areas, interactions with exhibits, or exposure to environmental hazards.
6.3 Child-Friendly Environment
While the Festival strives to create a family-friendly atmosphere, certain areas or activities may not be suitable for young children. Adults are encouraged to assess the appropriateness of each zone and exercise discretion accordingly.
6.4 Lost Children
In the event a child becomes separated from their adult, please report immediately to Festival staff or Event Security. A lost child protocol will be activated, prioritising swift reunification while adhering to child safety regulations under South Australian law.
7. PHOTOGRAPHY AND FILMING
7.1 Festival Rights
The Festival reserves the absolute right to photograph, film, or record any activities, performances, or interactions within the free entry sections. By entering, you grant irrevocable consent to the Festival and its authorised third parties (e.g., media partners, sponsors) to capture your image, likeness, or voice. Such material may be used indefinitely for promotional, marketing, archival, or other purposes across all media platforms; print, digital, broadcast, or otherwise, without compensation, restriction, or prior notification.
7.2 Liability Waiver
The Festival, its authorised parties, and any entities acquiring rights to this material bear no liability to you for its use, provided such use complies with applicable privacy laws (e.g., Privacy Act 1988 (Cth)). You waive any claim to royalties, damages, or injunctive relief arising from this consented use.
7.3 Personal Photography
You are welcome to take photographs or videos for personal, non-commercial use, capturing memories of your Festival experience, unless explicitly prohibited by Festival staff or Festival Plaza rules (e.g., during specific performances). However, professional-grade equipment such as telephoto lenses, tripods, or commercial recording devices is not permitted without prior written authorisation from the Festival’s Director of PR & Media Relations or Festival Plaza staff (see Section 9).
7.4 Respect for Others
When photographing or filming, please respect the privacy and comfort of fellow attendees. Avoid capturing individuals in a manner that could reasonably be deemed intrusive or offensive, as this may contravene South Australian privacy or harassment laws.
8. GOODS AND SERVICES FROM EXHIBITORS
8.1 Festival Role
Bastille Festival proudly hosts a diverse array of exhibitors, vendors, artisans, and service providers, offering goods and services such as food, beverages, handmade crafts, and interactive experiences within the free entry sections. These exhibitors operate as independent entities, enhancing the Festival’s vibrancy but functioning under their own auspices.
8.2 No Responsibility
The Festival explicitly disclaims any responsibility or liability for goods or services purchased from these individual exhibitors. All transactions, whether cash, card, or otherwise, are contractual agreements solely between you, the purchaser, and the exhibitor. The Festival acts merely as a facilitator of space and opportunity, not as a party to these exchanges.
8.3 Quality of Goods
The quality, safety, durability, and suitability of any goods or services rest entirely with the exhibitor. While the Festival undertakes diligent efforts to curate reputable exhibitors and promote high standards, we do not inspect, test, or endorse their offerings. Consequently, we neither guarantee nor warrant the condition or performance of these items, and we are not accountable for faulty, damaged, substandard, or otherwise unsatisfactory goods or services.
8.4 Refunds and Exchanges
Should you encounter issues with a purchase, such as defects, non-delivery, or dissatisfaction, any request for refunds, exchanges, repairs, or other remedies must be directed exclusively to the exhibitor from whom you made the purchase. The Festival will not mediate, facilitate, or assume liability for such resolutions, nor will it offer compensation or reimbursement for exhibitor-related grievances.
8.5 Consumer Rights
Your statutory rights as a consumer are fully preserved under the Australian Consumer Law (ACL), as applied in South Australia. This includes guarantees of acceptable quality, fitness for purpose, and remedies for non-compliance (e.g., repair, replacement, or refund). However, these rights are enforceable only against the exhibitor, not the Festival. Disputes or claims must be pursued directly with the exhibitor, and we recommend retaining receipts or proof of purchase to support any such action.
8.6 Reporting Concerns
If you believe an exhibitor’s conduct or offerings violate legal standards (e.g., misleading representations under the ACL), you may inform Festival staff. While we cannot intervene in individual transactions, we reserve the right to investigate and, if warranted, exclude exhibitors from future participation.

Refusal to comply with these searches will result in denial of entry, with no recourse for appeal on-site.
9.3 Venue-Specific Restrictions
Additional prohibited items may be outlined in Festival Plaza’s Venue Terms and Conditions, which take precedence. We strongly recommend reviewing these prior to attendance to avoid inconvenience.
9.4 Discretionary Authority

Entry to the free sections of the Festival is entirely at your own risk. You acknowledge that public events inherently carry potential hazards, environmental, physical, or otherwise and accept responsibility for your personal safety and property.

To the fullest extent permitted by law, including under the Australian Consumer Law (ACL) as applied in South Australia, you release the Festival (including its directors, officers, employees, contractors, agents, and volunteers) from any liability for loss, damage, injury, or death suffered by you or your property while attending—before, during, or after the event regardless of cause, except where such liability directly arises from the Festival’s proven negligence or breach of statutory obligations.

11. WEATHER AND EVENT CHANGES

The free entry sections may include outdoor spaces subject to South Australia’s variable weather conditions, ranging from scorching summer heat to unexpected rain or wind. The Festival is designed to operate rain or shine wherever feasible.
11.2 Modification Rights
The Festival reserves the unilateral right to modify, reschedule, or cancel activities within the free entry areas without prior notice. 11.3 No Compensation
As entry to these sections is free, no compensation, refunds, or alternative arrangements will be provided for changes or cancellations. We encourage attendees to check the Festival website or social media for updates, though we are not obligated to provide advance warning.

12. SMOKING AND ALCOHOL
12.1 Smoking Policy

This aligns with South Australian smoke-free laws and Festival Plaza’s regulations. Violators may be asked to extinguish items or leave the premises.
12.2 Alcohol Policy
Alcohol consumption is permitted exclusively in licensed areas operated by authorised vendors, adhering to the Liquor Licensing Act 1997 (SA) and RSA standards. Bringing your own alcohol (BYO) is strictly prohibited unless explicitly authorised in writing by Festival management. Unauthorised alcohol will be confiscated, and offenders may be ejected.

Festival staff and security are empowered to monitor compliance, confiscate prohibited items, and remove individuals exhibiting intoxication or supplying alcohol illicitly. Such actions may also trigger police involvement.
